Driving for Work: Mythbusters
52 common misconceptions – and the facts employers and drivers need to know
Myth 1: There are no drivers’ hours rules for van drivers

Many van drivers believe they operate outside drivers’ hours rules, but this is wrong.
While the EU drivers’ hours regulations apply primarily to vehicles over 3.5 tonnes, drivers of vans under 3.5 tonnes are still subject to both GB Domestic Drivers’ Hours and the Working Time Regulations 1998, which limit working hours and require rest periods.
Drivers must not drive for more than ten hours in any one day and must not be on duty for more than 11 hours in any one day.
Additionally, some van operations, such as those carrying certain goods or operating under specific licences, may fall under additional rules.
Employers must assess which regulations apply to their drivers and ensure compliance. Ignorance of the rules is not a legal defence, and both drivers and employers can face prosecution.
Driver takeaway:
Know which drivers’ hours rules apply to your vehicle and role – ignorance is not a legal defence.
Keep records, take required rest, and never drive beyond your legal limit.
Manager takeaway:
Audit which regulations govern each driver in your fleet.
Build compliant schedules, provide clear written guidance, and remember that both you and your driver can face prosecution for violations.
